Six Brothers Coffee – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, products, and services provided by Six Brothers Coffee (“the Company,” “we,” “us,” or “our”). By accessing or using our website, placing an order for green coffee beans or roasted coffee beans (“the Goods”), or utilising any of our services, you (“the User,” “you,” or “your”) agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our website or services.
1.1. Your access to and use of the Company’s website and services constitutes your express agreement to these Terms. These Terms form a legally binding contract between you and the Company.
1.2. The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will indicate the date of the latest revision at the top of these Terms. Your continued use of the website or services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates.
2.1. By using our website and services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.
2.2. To access certain features of our website, such as placing orders or viewing your order history, you may be required to register for an account. When creating an account, you agree to: (a) Provide accurate, current, and complete information as prompted by the registration form. (b) Maintain and promptly update your account information to keep it accurate, current, and complete. (c) Maintain the security and confidentiality of your password and identification. (d) Notify the Company immediately of any unauthorised use of your account or any other breach of security. (e) Accept all risks of unauthorised access to information and registrations.
2.3. The Company reserves the right to suspend or terminate your account and refuse any and all current or future use of the services, if any information provided during the registration process is found to be inaccurate, untrue, incomplete, or if you violate these Terms.
3.1. Six Brothers Coffee specialises in the sale of green coffee beans and roasted coffee beans. All descriptions of Goods, pricing, and availability are subject to change at any time without notice, at our sole discretion.
3.2. We make all reasonable efforts to display the colours, features, specifications, and details of the Goods accurately on the website. However, we do not guarantee that the colours, features, specifications, and details of the Goods will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the Goods.
3.3. All Goods are subject to availability. We reserve the right to discontinue any Goods at any time for any reason.
4.1. By placing an order through our website, you warrant that all information provided is accurate, complete, and current. You agree to pay all charges at the prices then in effect for your purchases, including any applicable shipping fees and taxes.
4.2. All payments must be made in Australian Dollars (AUD). We utilise third-party payment processors to facilitate transactions. By submitting your payment information, you authorise us to share your information with these third-party processors to complete the transaction.
4.3. The Company reserves the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our fraud prevention department. If an order is cancelled after you have been charged, we will issue a refund for the amount of the charge.

5.1. Shipping and delivery of Goods are subject to the terms outlined in Clause 8 (“Delivery”) of our Terms and Conditions of Sale.
5.2. Risk of loss and title for items purchased from the Company pass to you upon our delivery to the carrier.
6.1. All returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. You agree to comply with the terms and conditions set forth in our Refund Policy for any return or refund requests.
6.2. For detailed terms regarding claims for defects, shortages, or wrongful delivery, please refer to Clause 3 (“Claims for Defects, Shortages, or Wrongful Delivery”) of our Terms and Conditions of Sale.
7.1. All content on the Company’s website, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Six Brothers Coffee or its content suppliers and is protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7.2. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the website for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, transmission, republication, display, or performance, without the prior written permission of Six Brothers Coffee, is strictly prohibited.
8.1. You agree not to use the website or services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the website or interfere with any other party’s use and enjoyment of the website.
8.2. You shall not attempt to gain unauthorised access to any part of the website, other accounts, computer systems, or networks connected to the website through hacking, password mining, or any other means.
9.1. The website and all Goods and services provided are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
9.2. The Company does not warrant that the website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the website or the servers that make it available are free of viruses or other harmful components.

10.1. To the fullest extent permitted by applicable law, in no event shall Six Brothers Coffee, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) Your access to or use of or inability to access or use the website or services; (b) Any conduct or content of any third party on the website; (c) Any content obtained from the website; and (d) Unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
10.2. For specific limitations of liability related to the Goods, please refer to Clause 6 (“Limitation of Liability and Indemnification”) and Clause 7 (“Exclusion of Indirect Loss”) of our Terms and Conditions of Sale.
You agree to defend, indemnify, and hold harmless Six Brothers Coffee, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the website or services, including, but not limited to, your User Contributions, any use of the website’s content, services, and products other than as expressly authorised in these Terms, or your use of any information obtained from the website.
12.1. These Terms and your use of the website and services shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.
12.2. You agree to submit to the non-exclusive jurisdiction of the courts located in Queensland, Australia for the resolution of any disputes arising out of or relating to these Terms or your use of the website and services.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
These Terms, together with our Privacy Policy and Terms and Conditions of Sale, constitute the entire agreement between you and Six Brothers Coffee regarding your use of the website and services, superseding any prior agreements between you and us.
